Undue Influence in Property Transfers

As we are approaching World Elder Abuse Awareness Day, the decision of McFarlane v McFarlane serves as a looking glass that illuminates current elder abuse issues in the broader community.

In this case, a transfer of land from a mother to an adult son was set aside on the basis that the transfer was vitiated by undue influence.
